1. Acceptance of Terms

By accessing and using Portrana ("Service", "Platform", or "App"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms & Conditions, please do not use our Service.

These terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years of age or have obtained parental/guardian consent to use the Platform.

2. Service Description

Portrana is an AI-powered photo styling service that transforms your photos using various artistic styles. Our Service includes:

• AI-based image generation and styling
• Multiple artistic style presets (160+ styles across diverse categories)
• Image storage and gallery management
• Credit-based tier system (Free tier monthly, Pro Pack one-time purchase)
• Automatic watermarking on Free tier images

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice. Service features and availability may vary based on your subscription tier.

3. User Accounts and Obligations

3.1 Account Creation

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

3.3 Prohibited Uses

You agree not to use the Service to:

• Upload or generate content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Attempt to gain unauthorized access to the Service or related systems
• Use automated systems to access the Service without authorization
• Resell or redistribute the Service or generated content without permission
• Upload images containing identifiable persons without appropriate rights

4. Subscriptions and Billing

4.1 Pricing Plans

Portrana offers a credit-based system with free monthly credits and optional Pro Pack purchases:

Free Tier:

• Free: ₹0 - 25 credits per month (resets monthly), watermarked images, 30-day storage

Pro Packs (One-Time Purchase):

• 6-Month Pro: ₹2,499 one-time - 900 credits upfront, no watermark, permanent storage, 6 months of Pro perks
• Annual Pro: ₹3,999 one-time - 1,800 credits upfront, no watermark, permanent storage, 12 months of Pro perks

Credit Top-Ups:

• One-time credit packs available from ₹100 to ₹1,000
• Purchased credits never expire

Credit System:

• Cost per image: 2 credits per image (typical delivery: 30-60 seconds)
• All 160+ styles and aspect ratios are available on all tiers
• Free tier credits reset monthly on the 1st with no rollover

4.2 Billing and Renewal

Pro Packs and credit top-ups are one-time purchases processed through our secure payment partner (PhonePe). There are no recurring charges or automatic renewals. You are in complete control of when to purchase.

Free tier credits reset on the 1st of each month at 00:00 UTC and do not roll over. Pro Pack credits and purchased credit top-ups never expire and remain in your account until used.

When your Pro Pack period expires (6 or 12 months), you retain all remaining credits but lose Pro perks (no-watermark, permanent storage) until you purchase another Pro Pack.

4.3 Price Changes

We reserve the right to modify pricing for Pro Packs and credit top-ups at any time. Price changes will not affect purchases already made. New prices will be clearly displayed before any future purchase.

6. Intellectual Property Rights

6.1 Service Content

The Service, including its original content, features, and functionality, is owned by Portrana and is protected by copyright, trademark, and other intellectual property laws.

6.2 User-Generated Content

You retain all ownership rights to the original photos you upload to the Service. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your content solely for the purpose of providing the Service.

6.3 AI-Generated Content

You own the AI-generated styled images created through the Service. However, you acknowledge that similar or identical outputs may be generated for other users. You are responsible for ensuring you have appropriate rights to any persons or copyrighted materials in your uploaded images.

6.4 Commercial Use

Depending on your subscription tier, you may use AI-generated images for commercial purposes. Free tier users are limited to personal, non-commercial use only. Paid tier users may use generated images commercially in accordance with their subscription level.

6.5 Watermark Policy

Free tier images include a small watermark (Portrana logo) applied to the bottom-right corner of each generated image. This watermark is automatically added via CDN transformation and cannot be removed or disabled on the Free tier.

Pro tier subscribers receive watermark-free images. The watermark serves as a quality indicator and tier identifier. Attempting to remove watermarks from Free tier images through editing or other means is prohibited and may result in account termination.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTRANA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

8. Service Modifications and Termination

8.1 Service Modifications

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

8.2 Account Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

8.3 Data Retention After Termination

Upon account termination, your data retention depends on your tier at time of termination:

• Free Tier: Images automatically deleted after 30 days from generation date
• Pro Tier: Images stored permanently until you delete your account

After account deletion, all data including images, usage history, and profile information will be permanently deleted within 30 days and cannot be recovered.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any modifications constitutes acceptance of the updated Terms.
